Award of Contract
An evaluation team will examine each tender received, after which, negotiations may take place, RPA will negotiate and conclude the most economically advantageous terms with one tenderer on an objective basis.
Once the contract has been awarded, both the successful and unsuccessful tenderers will be notified. Unsuccessful tenderers may obtain feedback through written application to RPA.
A contract award notice will be placed in The Official Journal of the European Union’s (OJEU) (if applicable) within 48 days of the contract being awarded.
Relevant EU Thresholds
As we have already described, once the relevant financial threshold has been reached, the tender process will be subject to the detailed procedural rules of the European legislation.
The EU Directives cover contracts for
- Works - buildings and civil engineering contracts
- Supplies - purchasing of goods and supplies
- Services - all of the most commonly procured services, including advertising, property management, cleaning, management consultancy, financial and ICT related services, (See Annex IIA and Annex IIB of the revised public sector Directives).
Under directive 2004/17/EC, the relevant EU thresholds that are applicable to RPA contracts are as follows;
- Supplies- €412,000.
- Services- €412,000.
- Works- €5,150,000.
Contracts with a potential value above these thresholds are advertised on The Official Journal of the European Union’s appropriate website, http://ted.europa.eu/ and these advertisements may also be inserted in the national and local newspapers.
Lower Value Contracts
For contracts or purchases below the EU threshold values and not part of a
‘drawn down’ or framework contract, less formal procedures may be appropriate. For example:
- Supplies or Services less than €5,000 in value might be purchased on the basis of verbal quotes from one or more competitive suppliers;
- Supplies or Services contracts between €5,000 and upto €50,000 in value might be awarded on the basis of responses to specifications sent by fax or email to at least three suppliers or service providers.
- For contracts that are above €50,000 but below the EU thresholds the requirements may be less stringent but will still follow the same pattern as those above the EU threshold. These contracts will normally be advertised on the Department of Finance’s procurement website http://www.e-tenders.gov.ie
