EU Tendering Procedure
Where the overall value is likely to exceed certain financial thresholds then RPA is required to follow procedures laid down in the EU Public Procurement Regulations.
Within these regulations there are a number of tendering approaches that can be used and are outlined below.
Competitive Tendering Procedures
- The Open procedure means that any Competitive Tendering Procedures supplier can request a copy of the tender documents and then submit a response. This is infrequently used by RPA.
- The Restricted procedure is used when only a limited number of suppliers will be invited to submit a full tender. On the basis of economic and technical information provided by the suppliers the purchasing authority will select those they will invite to submit a tender. In comparison with the Open procedure this reduces the amount of work in evaluating the final tenders.
- The Competitive Dialogue is reserved for complex contracts such as Private Finance Initiative projects and is aimed at developing a solution in consultation with suppliers that fulfils the purchaser’s requirements.
- The Negotiated procedure can only be used in complex projects when the overall price cannot be determined in advance or when an Open, Restricted or Competitive Dialogue procedure has not resulted in a contract award.
The nature of RPA contracts means the tendering procedure used by RPA is normally the Negotiated Procedure.
RPA advertises and negotiates the terms of the contract. This process will normally involve the submission of formal tenders by at least three candidates.
